Staying compliant with Federal and New Jersey State Employee Benefit and HR Laws.
New Jersey does not require employers to offer health insurance to their employees, however, Federal Law (the ACA) mandates that New Jersey employers provide health benefits to employees if they have 50 or more full time employees, or face fines and penalties.
Employers who have been in business for more than two years, OR, if they have 25+ employees must offer a retirement plan to employees. It can be a traditional retirement plan such as a 401(k) or a similar plan, or they have the option of of enrolling in the New Jersey Secure Choice Savings Program.
New Jersey Employers must provide up to 40 hours of paid earned sick leave annually to most part-time and full-time employees. All NJ employers must adhere to the federal law, FMLA (Family Medical Leave Act), which gives employees up to 12-16 weeks unpaid leave for family illness or pregnancy. New Jersey state law allows 12 weeks of unpaid leave for birth, adoption, foster care, or family illness. New Jersey employees are also entitled to time off for jury duty, military obligations, and crime victim leave.
New Jersey employers must also provide unemployment benefits and workers compensation.
If between 2-9 employees, New Jersey employers must follow the New Jersey Mini-COBRA law and offer continuing health coverage to employees, and if over 20 employees then they are subject to federal COBRA laws.
*Some employers can satisfy the federal regulations for the ACA through and HRA, such as a ICHRA, or a health stipend. If you have less than 50 employees, we have programs that will allow you to offer robust benefits at affordable rates.
