Are you compliant with Federal and Pennsylvania State Employee Benefit and HR Laws?
Pennsylvania does not require employers to offer health insurance to their employees, however, Federal Law (the ACA) mandates that Pennsylvania employers provide health benefits to employees if they have 50 or more full time employees, or face fines and penalties.
While many employers in Pennsylvania offer 401ks and IRAs as part of the compensation package, state law does not mandate retirement benefits be offered at all.
Pennsylvania has no laws mandating paid sick time; however some counties do have their own laws regarding time for medical purposes (Philadelphia, Allegheny County, and Pittsburgh). All PA employers must adhere to the federal law, FMLA (Family Medical Leave Act), which gives employees up to 16 weeks unpaid leave for family illness or pregnancy. Pennsylvania employees are also entitled to time off for jury duty, military obligations, and crime victim leave.
Pennsylvania employers must also provide unemployment benefits and workers compensation.
If under 20 employees, Pennsylvania employers must follow the Pennsylvania Mini-COBRA law and offer continuing health coverage to employees, and if over 20 employees then they are subject to federal COBRA laws.
*Some employers can satisfy the federal regulations for the ACA through and HRA, such as a ICHRA, or a health stipend. If you have less than 50 employees, we have programs that will allow you to offer robust benefits at affordable rates.
