Working across the state line
Our staff live in both New Jersey and Pennsylvania. What does that change?
More than most employers expect. It affects which carrier networks make sense, which state leave and sick-time laws apply to each employee, whether TDI and FLI contributions are owed, and how income tax withholding works under the NJ–PA reciprocal agreement. We handle both states directly rather than coordinating between two brokers, so nothing falls in the gap.
Which state’s sick leave law applies to a Bucks County resident working in Trenton?
Generally the law of the state where the work is performed, which for a Trenton worksite means New Jersey Earned Sick Leave — regardless of where the employee sleeps. Pennsylvania has no statewide paid sick leave law, so employers who assume PA rules travel with the employee tend to get this backwards. We review it employee by employee.
Can one health plan cover employees in both states?
Usually yes, but network adequacy is the thing to check. A plan built on a New Jersey network can leave your Pennsylvania employees with poor access, and vice versa. In the Trenton–Bucks corridor we generally look for regional or national networks that cover both sides of the river without forcing anyone to change doctors.
Getting a plan in place
How small can we be and still get a group plan?
New Jersey’s small group market generally starts at one enrolling employee beyond the owner and runs through 50 employees. Above 50 you move into the large group market and the ACA employer mandate applies. We place plans across that whole range and will tell you which market you actually fall into.
We’re a nonprofit or trade association. Do the same options apply?
Yes. Nonprofits and associations buy in the same small and large group markets as any other employer. Trenton has an unusually high concentration of both, and the recurring challenge is lean staffing rather than plan design — which is where fractional HR tends to matter as much as the plan itself.
What is a level-funded plan and would it work for us?
Level-funded plans let you pay a steady monthly amount like a traditional plan, but you keep a share of unused claims funds in a good year and you get access to your claims data. They typically work well for healthier groups of roughly 25 to 100 employees. We model it against your fully insured renewal so you see the actual difference. More on level-funded plans.
When should we start working on our renewal?
Ninety days before your effective date at minimum, and 120 days if you want to seriously evaluate level-funded or self-insured options. Most January 1 groups should be starting in September.
Compliance
Do you handle ACA reporting and the New Jersey state filing?
Yes. We track full-time status, test affordability, and prepare and file Forms 1094-C and 1095-C. New Jersey also has its own state individual mandate reporting requirement, separate from the federal filing, which catches employers off guard every year. We hold state contracts. Does that add benefits obligations?
It can. Public contract work may carry prevailing wage requirements, fringe benefit obligations, and reporting that private-sector work does not, and contract-cycle hiring makes ACA measurement periods harder to get right. Bring us the contract terms and we will map them against your plan.
Who is responsible if our ERISA documents are wrong?
The plan sponsor — you — not the carrier and not the payroll company. That surprises people. Wrap documents, SPDs, participant notices and Form 5500 filings all sit with the employer, which is why our compliance service exists.
Working with us
Does switching brokers cost anything or disrupt our plan?
No. Broker commissions are already built into your premium whether or not your broker is doing anything for you. Changing the broker of record does not change your plan, your carrier, your rates, or your employees’ ID cards mid-year.
How are you compensated?
In most cases through commissions already built into your insurance premium. Where a fee-based arrangement makes more sense for your group, we say so upfront and put the scope and cost in writing before you commit to anything.
Will you actually come to Trenton, or is this all remote?
We come. Our office is about eight miles from downtown Trenton, roughly twenty minutes door to door. On-site enrollment meetings, renewal presentations and employee education sessions are how we work, not an upgrade you have to ask for.
